Welcome to Homie AI ("Homie," "we," "our," or "us"). These Terms of Service ("Terms") govern your access to and use of our mobile application, website, and related services (collectively, the "Service").

Please read these Terms carefully before using Homie. By creating an account or using the Service, you agree to be bound by these Terms and our Privacy Policy.

1. Acceptance of Terms

By accessing or using Homie, you confirm that:

• You are at least 13 years old (or 16 in certain jurisdictions)
• You have the legal capacity to enter into these Terms
• You agree to comply with all applicable laws and regulations
• If using on behalf of an organization, you have authority to bind that organization

If you do not agree to these Terms, you may not use the Service.

2. Service Description

Homie is an AI-powered household management platform that helps you:

• Track and manage household bills and expenses
• Create and organize tasks, shopping lists, and to-dos
• Schedule and manage calendar events
• Store household documents and contacts
• Collaborate with household members
• Interact via natural language chat with an AI assistant

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice.

3. Account Registration

To use Homie, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and update your information as needed
• Keep your login credentials confidential
• Not share your account with others
• Notify us immediately of any unauthorized access
• Accept responsibility for all activity under your account

We reserve the right to suspend or terminate accounts that violate these Terms or contain false information.

4. Household Management

4.1 Creating and Joining Households

You can create a household or join an existing one via invitation. The household owner has administrative privileges including member management and billing.

4.2 Shared Data

Data created within a household (bills, tasks, lists, events, documents) is shared with all household members. You are responsible for:

• Only inviting trusted individuals to your household
• The accuracy of data you create or modify
• Removing members who violate these Terms

4.3 Leaving a Household

You may leave a household at any time. Your contributed data may remain accessible to other members unless you delete it before leaving.

5. Subscriptions and Payments

5.1 Subscription Plans

Homie offers subscription plans based on household size. Plans include different features and member limits as described in the app.

5.2 Free Trial

New users may be eligible for a free trial period. You will not be charged until the trial ends. Cancel before the trial ends to avoid charges.

5.3 Billing

• Subscriptions are billed monthly or annually based on your selection
• Payment is processed through Apple App Store, Google Play Store, or our payment providers
• Subscriptions automatically renew unless canceled
• You authorize recurring charges to your payment method

5.4 Price Changes

We may change subscription prices with at least 30 days notice. Price changes take effect at your next renewal period.

5.5 Cancellation and Refunds

• You may cancel your subscription at any time
• Cancellation takes effect at the end of your current billing period
• No refunds for partial billing periods
• Refund requests for app store purchases must be made through Apple or Google

5.6 In-App Purchases (Mobile)

For subscriptions purchased through the Apple App Store or Google Play Store:

• Payment is charged to your App Store or Play Store account
• Subscriptions auto-renew unless turned off at least 24 hours before the end of the current period
• Manage subscriptions in your device's account settings
• Any unused portion of a free trial is forfeited when purchasing a subscription

6. Acceptable Use

You agree NOT to:

• Use the Service for any illegal purpose or to violate any laws
• Harass, abuse, threaten, or harm other users
• Upload malicious code, viruses, or harmful content
• Attempt to access other users' accounts or data
• Reverse engineer, decompile, or disassemble the Service
• Scrape, crawl, or collect data without permission
• Impersonate any person or entity
• Send spam, unsolicited messages, or chain letters
• Interfere with or disrupt the Service or servers
• Circumvent any security measures or access controls
• Use automated systems (bots, scrapers) without authorization
• Resell or redistribute the Service without permission

Violation of these rules may result in immediate termination of your account.

7. User Content

7.1 Your Content

You retain ownership of all content you submit to Homie, including bills, tasks, documents, and messages ("User Content").

7.2 License to Us

By using the Service, you grant us a worldwide, non-exclusive, royalty-free license to use, store, process, and display your User Content solely to provide and improve the Service.

7.3 Your Responsibilities

You are solely responsible for your User Content and represent that:

• You own or have rights to the content you submit
• Your content does not infringe any third-party rights
• Your content does not violate any laws
• Your content does not contain malicious or harmful material

8. AI-Generated Content

Homie uses artificial intelligence to process your requests and provide assistance. Regarding AI-generated content:

• AI responses are provided for informational purposes only
• We do not guarantee accuracy, completeness, or reliability of AI outputs
• You should verify important information independently
• AI is not a substitute for professional advice (financial, legal, medical, etc.)
• We are not liable for decisions made based on AI-generated content

9. Intellectual Property

9.1 Our Rights

Homie and its licensors own all rights, title, and interest in the Service, including:

• Software, code, and technology
• Design, graphics, and user interface
• Trademarks, logos, and brand elements
• Documentation and content we create

9.2 Limited License

We grant you a limited, non-exclusive, non-transferable license to use the Service for personal, non-commercial purposes in accordance with these Terms.

9.3 Restrictions

You may not copy, modify, distribute, sell, or create derivative works of any part of the Service without our written permission.

10. Third-Party Services

The Service may integrate with or contain links to third-party services, including:

• Payment processors (Apple, Google, RevenueCat)
• Cloud infrastructure providers
• AI service providers

These services have their own terms and privacy policies. We are not responsible for third-party services and recommend reviewing their terms.

11. Termination

11.1 By You

You may delete your account at any time through Settings or by contacting us. Upon deletion:

• Your access to the Service ends immediately
• Your data will be deleted in accordance with our Privacy Policy
• Active subscriptions should be canceled separately to avoid future charges

11.2 By Us

We may suspend or terminate your account if you:

• Violate these Terms
• Engage in fraudulent or illegal activity
• Abuse the Service or other users
• Fail to pay for subscriptions

We will provide notice when possible, but may act immediately for serious violations.

11.3 Effect of Termination

Upon termination, your right to use the Service ceases immediately. Sections that by their nature should survive (Limitation of Liability, Indemnification, Dispute Resolution) will remain in effect.

12. Disclaimers

We do not warrant that:

• The Service will be uninterrupted, secure, or error-free
• Results obtained will be accurate or reliable
• Any errors will be corrected
• The Service will meet your requirements

You use the Service at your own risk.

13. Limitation of Liability

Our total liability for any claims arising under these Terms shall not exceed the greater of:

• The amount you paid us in the 12 months preceding the claim, or
• $100 USD

Some jurisdictions do not allow limitation of liability, so these limitations may not apply to you.

14. Indemnification

You agree to defend, indemnify, and hold harmless Homie and its affiliates from any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any rights of another party
• Your User Content

15. Dispute Resolution

15.1 Informal Resolution

Before filing a formal dispute, you agree to contact us at legal@homieai.app to attempt informal resolution. We will try to resolve disputes within 30 days.

15.2 Binding Arbitration

If informal resolution fails, any dispute shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Arbitration will be conducted in English in San Francisco, California, or via video conference.

15.3 Class Action Waiver

You agree that disputes will be resolved on an individual basis. You waive any right to participate in class actions, class arbitrations, or representative actions.

15.4 Exceptions

Either party may bring claims in small claims court or seek injunctive relief for intellectual property violations.

16. Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles. For users outside the United States, you agree to comply with all local laws regarding online conduct and content.

17. Changes to Terms

We may update these Terms from time to time. When we make changes:

• We will update the "Last Updated" date
• For material changes, we will notify you via email or in-app notice
• Continued use after changes constitutes acceptance
• If you disagree with changes, you should stop using the Service

18. General Provisions

• Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and Homie
• Severability: If any provision is found invalid, the remaining provisions remain in effect
• Waiver: Our failure to enforce any right does not waive that right
• Assignment: You may not assign these Terms; we may assign them freely
• Force Majeure: We are not liable for failures due to circumstances beyond our control
• Notices: We may send notices via email, in-app messages, or posting on the Service
